Matters not regulated in the cassation appeal proceedings

If there are no specific provisions on proceedings before the Supreme Court, the provisions on appeal shall apply mutatis mutandis to such proceedings, however, the cassation appeal may also be withdrawn by the party itself, and the time limit for preparing the justification of the judgment by the Supreme Court is one month. In cassation proceedings, the possibility of appropriate application of Art. 380 kpc (I CKN 259/2000).

Withdrawal of a complaint is a procedural act not subject to court control (I CKN 820/97). Withdrawal of the complaint results in discontinuation of the cassation proceedings (IV CKN 403/2000).
