Admission for examination

The Supreme Court accepts a cassation appeal for consideration if: there is a significant legal issue in the case, there is a need to interpret legal provisions that raise serious doubts or cause discrepancies in court decisions, the proceedings are invalid, the cassation appeal is of course justified.

The Supreme Court decides on the acceptance or refusal to accept a cassation appeal for consideration in a closed session. Fulfillment of the construction requirement of a cassation appeal consists in submitting an application for acceptance of the complaint for consideration and any justification for this application, and only this is subject to control by the court of second instance, because the substantive assessment of the validity of the application rests with the Supreme Court adjudicating on the acceptance of the complaint for consideration.
