Rejection of the appeal

If the lawsuit was rejected or there was a basis for discontinuing the proceedings, the Supreme Court repeals the judgments issued in the case and rejects the lawsuit or discontinues the proceedings.

Court pursuant to Art. 203 § 4 of the Code of Civil Procedure in connection with Art. 13 § 2 of the Code of Civil Procedure, should consider the withdrawal of the application inadmissible when the circumstances of the case indicate that the action is inconsistent with the law or the principles of social coexistence or tends to circumvent the law (IV CKN 1153/2000).
