Residential real estate in Poland
The other type of real estate in Poland is the so-called residential real estate- it is created on the basis of the law on residences. The dwelling house is a dwelling, which, as a result of separation according to the principles set out in that law. In order to establish ownership of a property, it is necessary to register this property in the land and mortgage register. Separation involves the need to establish a land register and make an entry in the property. With the ownership of the residential real estate in Poland is associated so-called common property, which is a land and parts of the building used by all owners of the building. Common property is a co-ownership in fractional parts, it can not be demanded to be abolished as long as the ownership of building remains the same. The common property may belong to the premise (cells, attics, garages), even if it does not adhere to the building, but must be located on the property.
