Civil law's point of view on real estate in Poland

According to article 46 § 1 of the polish Civil Code, "real estate in Poland is a part of the land that constitutes a separate property (land), as well as permanently attached buildings or parts of such buildings". Property should be separated in terms of legal (ownership) and physical (land-geodetic).

Cadastral point of view on real estate in Poland

According to the provisions of article 24 § 1 of polish Act on Land and Mortgage "real estate in Poland is a part of the land area for which the Land and Mortgage Register is established". The fact of establishing a separate land and mortgage register for a real estate is a formal requirement for its separation - "Land and Mortgage Register is kept to determine the legal status of the property". The real estate description in the Land and Mortgage Register is based on cadastral real estate data.
