Concept.
By a settlement, the parties make mutual concessions within the scope of a legal relationship existing between them in order to avoid uncertainty concerning claims resulting from that relationship or to ensure their performance or in order to avoid an existing or potential dispute.
Error.
The legal effects of a settlement executed under the influence of an error may be avoided only if the error concerns facts which, according to the settlement, both parties considered undeniable, and the dispute or uncertainty would not have arisen if the parties had known the true state of affairs at the time the settlement was executed.The legal effects of a settlement cannot be avoided on the grounds that evidence has been discovered of the claims to which the settlement relates unless the settlement was executed in bad faith.
