Jurisdiction of polish court in divorce cases

The general rule of the court jurisdiction in Poland states that the case may be brought before a polish court if the defendant is domiciled or a resident in Poland.

In addition to marital matters and matters relating to matrimonial property relations, the polish courts can also rule if:

1) both spouses have their last domicile or last habitual residence in Poland if one of them still resides in the Republic of Poland;

2) the spouse who is the plaintiff has at least one year's residence in Poland at least before the commencement of proceedings;

3) the spouse who is the plaintiff is a polish citizen and has at least six months residence in Poland before the initiation of proceedings;

4) both spouses are polish citizens
