Division of assets after a divorce in Poland

1. INTRODUCTION TO DIVISION OF ASSETS AFTER A DIVORCE

At the request of one of the spouses, the court may, in a divorce verdict, divide the common property if it does not result in an excessive delay in the proceedings.

2. INVENTORY

Carrying out the division of assets is done only it there is no dispute between the parties as to the composition and manner of the division of that property.

3. SETTLEMENT

It is possible for the parties to divide the common property by way of a court settlement, provided that such settlement becomes effective at the time of the final decision of divorce. 

4. PARTIAL DIVISION OF ASSETS AFTER A DIVORCE

In the event of a partial division, each party may demand the remainder of the joint property, not covered by a divorce verdict, in ordinary proceedings.
