Definition of a divorce in Poland

Divorce in Poland is a civil dissolution of a valid marriage by a court at the request of one or both spouses. Divorce in addition to widowhood and marriage annulment is one of the circumstances leading to end of a marriage. Among types of divorces one can distinguish:

• divorce decree with an adjudication of the fault (ending the marriage with the fault of one of the spouses) - in which the court may order an alimony from the person for whom the marriage ends in favor of the injured person;
• divorce without adjudication of the fault (in agreement with the parties) - in this case the spouses waive their claim rights against themselves.
