Apartment after a divorce in Poland

If the spouses share an apartment, in Poland the court in the divorce verdict also declares how to use the apartment for the time when the divorced spouses live together. In exceptional cases, if the behavior of one of the spouses prevents the former spouses from living together, the court may order his eviction at the request of the other spouse. At the request of the parties, the court may, in a divorce verdict, also agree to split a flat or grant a flat to one of the spouses if the other spouse agrees to leave the apartment without providing a replacement and a substitute room if the division or assignment of one of the spouses is possible.

Before passing a verdict on the spouses' common residence, the court takes into account, in particular, the needs of the children and the interest of a spouse entrusted with the parental responsibility.
