Response to the appeal

After serving the appeal on the opposing party, the court of first instance shall immediately present the case files to the court of second instance.

The opposing party may, within two weeks from the date of delivery of the appeal, submit a response to the appeal directly to the court of second instance. The requirement to deliver a copy of the appeal to the opposing party will be met not only when it is delivered through the Court, but also when the party confirms receipt of the copy of the appeal.

The complainant may present new facts and (or) evidence only in the appeal, and the other party may present facts and evidence opposing them in the response to the appeal, provided that they demonstrate that they could not have used them in the proceedings before the court of first instance.
